Chapter 24.--DRAINAGE AND LEVEES
Article 12.--WATERSHED DISTRICTS

      24-1235.   Same; township roads; permit application; authority andduties of board of township trustees; publication and notice.(a) Upon application of the board of directors of any watersheddistrict, the board of trustees of any township is hereby authorized topermit the intermittent closing of any township road located within theboundaries of such watershed district whenever in its judgment it isnecessary to do so and when the road will be intermittently subject toinundation by flood waters retained by an approved watershed retentionstructure.

      (b)   Before any permit may be issued for the temporary inundation andclosing of such a road, an application for such permit shall be made to theboard of trustees of the township involved by the watershed district. Theapplication shall specify the road involved and shall request that a permitbe granted to the district to allow the intermittent closing of the road.

      (c)   Upon receipt of such an application, the board of trustees shallgive notice of the proposed action by publication once each week for two(2) consecutive weeks in a newspaper of general circulation in the county,and such notice shall contain a description of the places of beginning andthe places of ending of such intermittent closing. In addition to suchpublication, the board of trustees shall give notice to all publicutilities or common carriers having facilities located within the rights-of-wayof any roads being closed by mailing copies of such notice to theoffices of such public utilities or common carriers located within thecounty, or if no office is located within said county, then to the officeof such utilities or common carriers located nearest to said county. Notsooner than three (3) days after the last publication and not sooner thanfourteen (14) days after the mailing of such notice, such board may issueits permit with respect to such road.
