Chapter 24.--DRAINAGE AND LEVEES
Article 8.--LEVEES

      24-818.   Same; moneys, custody and use; right to use lands.The county treasurer of the county in which the district is situatedshall receive, safely keep and pay on orders of the board of countycommissioners all funds belonging to the district, and shall be liableupon his official bonds for such funds and for any default in the properperformance of his duty in that respect. The county treasurer shall havepower to receive and receipt for special assessments which any owner ofland may desire to pay after the apportionment and levy thereof by theboard of county commissioners. The purchase price of all bonds sold bythe board of county commissioners for cash shall be paid directly tosuch county treasurer, and he shall retain the same, and all taxes,special assessments and other funds of the district collected orreceived by him, until paid out as herein provided.

      The county clerk shall, when directed by the board of countycommissioners, prepare and deposit a copy of the viewers' report in theoffice of the county treasurer, and the board of county commissionersshall forthwith direct the county treasurer to at once set aside andappropriate for the payment of the persons severally entitled theretosufficient of the funds of said district to satisfy the amount requiredby said report, and on demand pay the same to the persons respectivelyentitled thereto; that when sufficient funds of said district have beendeposited with the county treasurer, and the same have been set asideand appropriated as hereinbefore directed for the payment of personsseverally entitled thereto, the right to the perpetual use of all landsshown by such report to have been appropriated shall vest in the boardof county commissioners for the purpose for which the same werecondemned and taken as stated in such report, and the board of countycommissioners shall have the right forthwith to construct a levee orother works across the right of way of any railroad or street-railwaycompany at the point specified in such report, and to occupy all otherlands set off and appropriated for such purpose in said report.
