Chapter 48.--MILITIA, DEFENSE AND PUBLIC SAFETY
Article 2.--KANSAS ARMY AND AIR NATIONAL GUARD

      48-281.   National guard life insurance premiumreimbursements; fund; limitation when other death benefits payable.(a) There is hereby created in the state treasury thenational guard lifeinsurance premium reimbursement fund which shall be administered by theadjutant general. Allmoneys credited to such fund shall be used only to reimburse eligible membersof the Kansas armyand air national guard for premiums paid for any period on or after September1, 2005, under theservicemembers' group life insurance program pursuant to 38 U.S.C. §1965et seq., as amended, andnot otherwise reimbursed by the federal government, for death benefit coverageof the member onfederal active duty in a combat area.

      (b)   All expenditures from the national guard life insurance premiumreimbursement fundshall be made in accordance with appropriation acts upon warrants of thedirector of accounts andreports issued pursuant to vouchers approved in the manner prescribed by law.

      (c)   The adjutant general is hereby authorized to receive moneys from anygrants, gifts,contributions or bequests made for the purposes of this section and to expendsuch moneys for thepurpose for which received.

      (d)   For the purpose of carrying out the provisions of this section, andsubject to theavailability of appropriations therefor, the adjutant general shall develop andimplement a plan (1)to determine eligibility for reimbursement from the national guard lifeinsurance premiumreimbursement fund for premiums paid under the servicemembers' group lifeinsurance programpursuant to 38 U.S.C. §1965 et seq., as amended, and not otherwisereimbursed by the federalgovernment, for death benefit coverage of the member on federal active duty ina combat area, and(2) to provide for such other aspects of the plan as the adjutant generaldeems necessary.

      (e)   Nothing in this section is intended to alter, amend or change theeligibility or applicability of the servicemembers' group life insuranceprogram pursuant to 38 U.S.C. §1965 etseq., asamended, or any rights, responsibilities or benefits thereunder.

      (f)   On and after the effective date of this act, and notwithstanding theprovisions of section1 or section 2 of chapter 207 of the 2005 session laws of Kansas, andamendments thereto,K.S.A. 48-282, and amendments thereto, or any other provision of law to thecontrary, no member ofthe Kansas army or air national guard shall be eligible for the death benefitprescribed in section 1of chapter 207 of the 2005 session laws of Kansas, and amendments thereto, orin K.S.A. 48-282, and amendments thereto, if such member is enrolled in theservicemember'sgroup life insuranceprogram pursuant to 38 U.S.C. §1965 et seq., as amended, after August31, 2005. No amount shallbe paid from the national guard life insurance premium reimbursement fund withrespect to any caseof any member of the Kansas army or air national guard for whom any deathbenefit has been paidpursuant to section 1 or section 2 of chapter 207 of the 2005 session laws ofKansas, andamendments thereto, or pursuant to K.S.A. 48-282, and amendmentsthereto.
