Chapter 68.--ROADS AND BRIDGES
PART II.--BRIDGES
Article 11.--GENERAL PROVISIONS

      68-1120.   Payment on contracts; liability on bond of contractor.The board of county commissioners may make partial payments upon writtenestimate of their engineer, on any contract for bridge or culvert workunder this act as the work progresses, exceptthat at no time shall more than95% of the estimate of the materials at suchtimefurnished and of the work at such time done be paid in advance of the fulland satisfactory completion of the work. Final payment shallnot be madeon any of such contracts until the county engineerhas inspected the structure and certified in writing that the work has beendone properly and completed according to contract, plans andspecifications, and the labor and materials have been paid for,and the countyengineer'scertificate to that effect has been filed in the officeof the countyclerk. The acceptance of any bridge or the approval thereof shall notrelieve the contractor or sureties of such contractor from any liabilityfor any failure to fully perform the contract or under any provisions ofsuch contractor's bond.
