96.165 City classified from third class to second class to continue operation of combined electric and water system under provisions of KRS 96.171 to 96.188 -<br>- When. Immediately upon the effective date of any act of the General Assembly changing the <br>classification of any city of the third class to a city of the second class, if such city while <br>operating as a city of the third class had accepted and was operating under the provisions <br>of KRS 96.171 to KRS 96.188, inclusive, relating to the operation of a combined electric <br>and water system, such city of the second class shall continue to operate such combined <br>electric and water plant under the provisions of said sections of the Kentucky Revised <br>Statutes as amended and said sections, and each of them, as amended, hereby are adopted <br>by reference and shall apply to such city of the second class and the combined electric and <br>water system of such city of the second class shall be operated under the provisions of <br>KRS 96.172 and 96.188, as amended. Said sections of the Kentucky Revised Statutes <br>shall govern the appointment, qualifications, tenure, powers and duties of the members of <br>the electric and water plant board of the city and the powers and duties of such board. The <br>members of such board shall hold office for the respective terms to which they were <br>appointed and qualified, and upon the expiration of their respective terms and upon the <br>occurrence of a vacancy, the appointments to fill such expired terms or such vacancies <br>shall be made as provided in said statutes. Such appointments shall be made by the mayor <br>and approved by the legislative body of the city. All contracts and obligations incurred by <br>such board, and between the city and such board, shall remain in full force and effect <br>whether made after or prior to such city becoming a city of the second class.
