107.390 Condemnation powers of board. The district shall have the same power to condemn property for its purposes as the <br>Department of Highways of the Commonwealth of Kentucky, and shall institute any <br>action for condemnation under the provisions of the statutes applicable to said <br>department. The official order of the board shall be conclusive of the public use of the <br>condemned property and the board's decision as to the necessity for taking the property <br>will not be disturbed in the absence of fraud, bad faith, or abuse of discretion. History: Created 1970 Ky. Acts ch. 155, sec. 8.
