165A.340 State Board for Proprietary Education -- Membership -- Terms -- Meetings -- Powers -- Compensation. (1) There is hereby established a State Board for Proprietary Education which shall consist of eleven (11) voting members to be appointed by the Governor as follows: <br>(a) Three (3) members representative of privately owned educational institutions appointed from a list of seven (7) names submitted by the Kentucky <br>Association of Career Colleges and Schools; (b) Three (3) members representative of technical schools appointed from a list of seven (7) names submitted by the Kentucky Association of Career Colleges <br>and Schools; and (c) Five (5) members representative of the public at large. (2) The term of each member shall be four (4) years or until a successor is appointed. If a vacancy occurs on the board, a new member shall be appointed to serve the <br>remainder of the unexpired term. (3) The director of the Office of Occupations and Professions in the Public Protection Cabinet shall serve as executive director of the board. Members of the board shall <br>annually elect one (1) of their number as chairman. The board may make all rules <br>and regulations, including the establishment of fees and other charges consistent <br>with the provisions of this chapter, as may be necessary to carry out the provisions <br>and purposes of this chapter. (4) The board shall hold meetings at least four (4) times a year and as frequently as it deems necessary at the times and places as the board may designate and the majority <br>of the members shall constitute a quorum. (5) The board may sue and be sued in its own name. <br>(6) The members of the board shall receive one hundred dollars (&#36;100) per day for each meeting attended and may be paid their travel and other expenses while employed <br>upon the business of the board. (7) The board shall administer the provisions of law pertaining to the conduct, operation, maintenance, and establishment of proprietary education institutions, and <br>the activities of agents thereof when acting as such. (8) The board shall have the power to subpoena witnesses and school records as it deems necessary. Effective: July 15, 2010 <br>History: Amended 2010 Ky.
