205.770 Child custody and visitation rights. (1) If a child is receiving services under Part D of Title IV of the Social Security Act and the cabinet has taken action under the provisions of KRS 205.715 to 205.800, <br>403.215, 405.405 to 405.530 and 530.050 to obtain support on behalf of the child, <br>matters concerning custody of the child and visitation rights of the parents shall not <br>be used by either parent as a reason not to pay child support to the cabinet. (2) Upon a determination by the cabinet that such would be in the best interest of the child, the cabinet may petition a Circuit Court of proper jurisdiction in the name of <br>the child to make a determination of child custody and visitation rights of a parent. Effective: July 15, 1988 <br>History: Amended 1988 Ky. Acts ch. 411, sec. 13, effective July 15, 1988. -- Created 1974 Ky. Acts ch. 343, sec. 14.
