491.330. Whenever it shall appear to the satisfaction of theassociate circuit judge that any person duly subpoenaed to appearbefore him in a suit shall have failed without just cause toattend as a witness in conformity to such subpoena, and the partyin whose behalf the subpoena was issued, or his attorney, shallmake oath that the testimony of such witness is material, theassociate circuit judge shall have power to issue an attachmentto compel the attendance of such witness.
