Misrepresentation of grade, classification, quality orcondition--penalty.

265.110. If any quantity of any agricultural product shallhave been inspected and a certificate issued hereunder showingthe grade, classification, quality or condition thereof no personshall represent that the grade, classification, quality orcondition of such product at the time and place of suchinspection was other than as shown by such certificate. Wheneverany standard for the grading or classification of anyagricultural product becomes effective under this chapter, itshall be unlawful in or in connection with any transaction ortransactions involving such product in commerce subject to thejurisdiction of this state or in any publication in this state ofa price or prices for or in connection with such transaction ortransactions for any person to indicate the grade of anyagricultural product which is of or within the grades fixed insaid standard for such product by any name, description ordesignation or any system of names, descriptions or designationsnot used in said standard. Whenever any standard for a containerfor an agricultural product becomes effective under this chapter,no person thereafter shall manufacture for commerce within thejurisdiction of this state, or sell, ship, or offer for sale insuch commerce any container, either filled or unfilled, to whichthe standard is applicable which does not comply with suchstandard subject to such tolerances as may be permitted underthis chapter. Any person violating this section shall be guiltyof a misdemeanor and upon conviction thereof shall be fined notless than twenty-five dollars or not more than one hundreddollars.
