Location of plants--restrictions and exceptions.

269.170. No disposal plant or dead animal substation shallbe located or constructed at any place in this state inside of,or within two miles of the nearest point of the corporate limitsof, any city or town; nor within one mile of the nearest boundaryof the lands then owned or controlled in connection either withany state, county, township, city, or town park; or of any publicschool or hospital; or of any charitable, religious oreducational institution; provided, however, that where a disposalplant for dead bodies is now operating that does not comply withthe provisions of this section as to location, such disposalplant may continue operation in its present location, providedthe plant meets all the provisions and regulations of thischapter as to sanitation, and is not a public nuisance or apublic health hazard.
