Penalties for violations.

281.310. 1. Any person violating subdivision (1) ofsubsection 1 of section 281.240 shall be guilty of an infractionand upon conviction shall be fined not more than one thousanddollars.

2. Any person violating any provisions of sections 281.210to 281.310, other than subdivision (1) of subsection 1 of section281.240 or subsection 3 of this section, shall be guilty of aninfraction and upon conviction shall be fined not more than fivehundred dollars for the first offense and fined not more than onethousand dollars for each subsequent offense; provided, that, anyoffense committed more than five years after a previousconviction shall be considered a first offense; and provided,further, that in any case where a registrant was issued a warningby the director pursuant to the provisions of sections 281.210 to281.310, such registrant violates any provisions of sections281.210 to 281.310, that registrant shall be guilty of a class Amisdemeanor and the registration of the pesticide with referenceto which the violation occurred shall terminate automatically. Apesticide for which the registration has been terminated may notagain be registered unless the pesticide, its labeling, and othermaterial required to be submitted appear to the director tocomply with all the requirements of sections 281.210 to 281.310.

3. Notwithstanding any other provisions of this section, noperson shall knowingly or with reckless disregard of theconsequences, use or reveal information relative to formulas ofproducts acquired under authority of section 281.260 or otherinformation which the submitter designates as trade secret orconfidential, without obtaining prior written consent of thesubmitter. Any person violating this subsection shall be guiltyof a class A misdemeanor.

4. Nothing in sections 281.210 to 281.310, shall impose orcontinue to effect any requirement for labeling or packaging inaddition to or different from those required under federalregulations.
