Definitions.

300.010. The following words and phrases when used in thisordinance mean:

(1) "Alley" or "alleyway", any street with a roadway ofless than twenty feet in width;

(2) "All-terrain vehicle", any motorized vehiclemanufactured and used exclusively for off-highway use which isfifty inches or less in width, with an unladen dry weight of sixhundred pounds or less, traveling on three, four or more lowpressure tires, with a seat designed to be straddled by theoperator, and handlebars for steering control;

(3) "Authorized emergency vehicle", a vehicle publiclyowned and operated as an ambulance, or a vehicle publicly ownedand operated by the state highway patrol, police or firedepartment, sheriff or constable or deputy sheriff, trafficofficer or any privately owned vehicle operated as an ambulancewhen responding to emergency calls;

(4) "Business district", the territory contiguous to andincluding a highway when within any six hundred feet along thehighway there are buildings in use for business or industrialpurposes, including but not limited to hotels, banks, or officebuildings, railroad stations and public buildings which occupy atleast three hundred feet of frontage on one side or three hundredfeet collectively on both sides of the highway;

(5) "Central business (or traffic) district", all streetsand portions of streets within the area described by cityordinance as such;

(6) "Commercial vehicle", every vehicle designed,maintained, or used primarily for the transportation of property;

(7) "Controlled access highway", every highway, street orroadway in respect to which owners or occupants of abutting landsand other persons have no legal right of access to or from thesame except at such points only and in such manner as may bedetermined by the public authority having jurisdiction over thehighway, street or roadway;

(8) "Crosswalk", (a) That part of a roadway at anintersection included within the connections of the lateral linesof the sidewalks on opposite sides of the highway measured fromthe curbs, or in the absence of curbs from the edges of thetraversable roadway;

(b) Any portion of a roadway at an intersection orelsewhere distinctly indicated for pedestrian crossing by linesor other markings on the surface;

(9) "Curb loading zone", a space adjacent to a curbreserved for the exclusive use of vehicles during the loading orunloading of passengers or materials;

(10) "Driver", every person who drives or is in actualphysical control of a vehicle;

(11) "Freight curb loading zone", a space adjacent to acurb for the exclusive use of vehicles during the loading orunloading of freight (or passengers);

(12) "Highway", the entire width between the boundary linesof every way publicly maintained when any part thereof is open tothe use of the public for purposes of vehicular travel;

(13) "Intersection", (a) The area embraced within theprolongation or connection of the lateral curb lines, or, ifnone, then the lateral boundary lines of the roadways of twohighways which join one another at, or approximately at, rightangles, or the area within which vehicles traveling upondifferent highways joining at any other angle may come inconflict;

(b) Where a highway includes two roadways thirty feet ormore apart, then every crossing of each roadway of such dividedhighway by an intersecting highway shall be regarded as aseparate intersection. In the event such intersecting highwayalso includes two roadways thirty feet or more apart, then everycrossing of two roadways of such highways shall be regarded as aseparate intersection;

(14) "Laned roadway", a roadway which is divided into twoor more clearly marked lanes for vehicular traffic;

(15) "Motor vehicle", any self-propelled vehicle notoperated exclusively upon tracks, except farm tractors andmotorized bicycles;

(16) "Motorcycle", every motor vehicle having a seat orsaddle for the use of the rider and designed to travel on notmore than three wheels in contact with the ground, but excludinga tractor;

(17) "Motorized bicycle", any two-wheeled or three-wheeleddevice having an automatic transmission and a motor with acylinder capacity of not more than fifty cubic centimeters, whichproduces less than three gross brake horsepower, and is capableof propelling the device at a maximum speed of not more thanthirty miles per hour on level ground;

(18) "Official time standard", whenever certain hours arenamed herein they shall mean standard time or daylight-savingtime as may be in current use in the city;

(19) "Official traffic control devices", all signs,signals, markings and devices not inconsistent with thisordinance placed or erected by authority of a public body orofficial having jurisdiction, for the purpose of regulating,warning or guiding traffic;

(20) "Park" or "parking", the standing of a vehicle,whether occupied or not, otherwise than temporarily for thepurpose of and while actually engaged in loading or unloadingmerchandise or passengers;

(21) "Passenger curb loading zone", a place adjacent to acurb reserved for the exclusive use of vehicles during theloading or unloading of passengers;

(22) "Pedestrian", any person afoot;

(23) "Person", every natural person, firm, copartnership,association or corporation;

(24) "Police officer", every officer of the municipalpolice department or any officer authorized to direct or regulatetraffic or to make arrests for violations of traffic regulations;

(25) "Private road" or "driveway", every way or place inprivate ownership and used for vehicular travel by the owner andthose having express or implied permission from the owner, butnot by other persons;

(26) "Railroad", a carrier of persons or property uponcars, other than streetcars, operated upon stationary rails;

(27) "Railroad train", a steam engine, electric or othermotor, with or without cars coupled thereto, operated upon rails,except streetcars;

(28) "Residence district", the territory contiguous to andincluding a highway not comprising a business district when theproperty on such highway for a distance of three hundred feet ormore is in the main improved with residences or residences andbuildings in use for business;

(29) "Right-of-way", the right of one vehicle or pedestrianto proceed in a lawful manner in preference to another vehicle orpedestrian approaching under such circumstances of direction,speed and proximity as to give rise to danger of collision unlessone grants precedence to the other;

(30) "Roadway", that portion of a highway improved,designed or ordinarily used for vehicular travel, exclusive ofthe berm or shoulder. In the event a highway includes two ormore separate roadways the term "roadway" as used herein shallrefer to any such roadway separately but not to all such roadwayscollectively;

(31) "Safety zone", the area or space officially set apartwithin a roadway for the exclusive use of pedestrians and whichis protected or is so marked or indicated by adequate signs as tobe plainly visible at all times while set apart as a safety zone;

(32) "Sidewalk", that portion of a street between the curblines, or the lateral lines of a roadway, and the adjacentproperty lines, intended for use of pedestrians;

(33) "Stand" or "standing", the halting of a vehicle,whether occupied or not, otherwise than for the purpose of andwhile actually engaged in receiving or discharging passengers;

(34) "Stop", when required, complete cessation frommovement;

(35) "Stop" or "stopping", when prohibited, any haltingeven momentarily of a vehicle, whether occupied or not, exceptwhen necessary to avoid conflict with other traffic or incompliance with the directions of a police officer or trafficcontrol sign or signal;

(36) "Street" or "highway", the entire width between thelines of every way publicly maintained when any part thereof isopen to the uses of the public for purposes of vehicular travel."State highway", a highway maintained by the state of Missouri asa part of the state highway system;

(37) "Through highway", every highway or portion thereof onwhich vehicular traffic is given preferential rights-of-way, andat the entrances to which vehicular traffic from intersectinghighways is required by law to yield rights-of-way to vehicles onsuch through highway in obedience to either a stop sign or ayield sign, when such signs are erected as provided in thisordinance;

(38) "Traffic", pedestrians, ridden or herded animals,vehicles, streetcars and other conveyances either singly ortogether while using any highway for purposes of travel;

(39) "Traffic control signal", any device, whethermanually, electrically or mechanically operated, by which trafficis alternately directed to stop and to proceed;

(40) "Traffic division", the traffic division of the policedepartment of the city, or in the event a traffic division is notestablished, then said term whenever used herein shall be deemedto refer to the police department of the city;

(41) "Vehicle", any mechanical device on wheels, designedprimarily for use, or used, on highways, except motorizedbicycles, vehicles propelled or drawn by horses or human power,or vehicles used exclusively on fixed rails or tracks, cottontrailers or motorized wheelchairs operated by handicappedpersons.
