301.3043. 1. Any member of the Missouri Botanical Garden, after anannual payment of an emblem-use authorization fee to the Missouri BotanicalGarden, may receive special license plates for any vehicle the member owns,either solely or jointly, other than an apportioned motor vehicle or acommercial motor vehicle licensed in excess of eighteen thousand poundsgross weight. The Missouri Botanical Garden hereby authorizes the use ofits official emblem to be affixed on multiyear personalized license platesas provided in this section. Any contribution to the Missouri BotanicalGarden derived from this section, except reasonable administrative costs,shall be used solely for the purposes of the Missouri Botanical Garden.Any member of the Missouri Botanical Garden may annually apply for the useof the emblem.
2. Upon annual application and payment of a thirty-five dollaremblem-use contribution to the Missouri Botanical Garden, the MissouriBotanical Garden shall issue to the vehicle owner, without further charge,an emblem-use authorization statement, which shall be presented by thevehicle owner to the director of revenue at the time of registration. Uponpresentation of the annual statement and payment of a fifteen dollar fee inaddition to the regular registration fees, and presentation of anydocuments which may be required by law, the director of revenue shall issueto the vehicle owner a special license plate which shall bear the emblem ofthe Missouri Botanical Garden. Such license plates shall be made withfully reflective material with a common color scheme and design, shall beclearly visible at night, and shall be aesthetically attractive, asprescribed by section 301.130. Notwithstanding the provisions of section301.144, no additional fee shall be charged for the personalization oflicense plates pursuant to this section.
3. A vehicle owner who was previously issued a plate with theMissouri Botanical Garden's emblem authorized by this section, but who doesnot provide an emblem-use authorization statement at a subsequent time ofregistration, shall be issued a new plate which does not bear the MissouriBotanical Garden's emblem, as otherwise provided by law. The director ofrevenue shall make necessary rules and regulations for the enforcement ofthis section, and shall design all necessary forms required by thissection.
