Friends of Kids with Cancer special license plates, application, fee.

301.3122. 1. Any person may receive special license plates asprescribed by this section, for any motor vehicle such person owns, eithersolely or jointly, other than an apportioned motor vehicle or a commercialmotor vehicle licensed in excess of eighteen thousand pounds gross weight,after an annual contribution of an emblem-use authorization fee to theFriends of Kids with Cancer. The Friends of Kids with Cancer herebyauthorizes the use of its official emblem to be affixed on multiyearpersonalized license plates as provided in this section. Any person mayannually apply for the use of the emblem.

2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to the Friends of Kids with Cancer, theorganization shall issue to the vehicle owner, without further charge, anemblem-use authorization statement, which shall be presented by the ownerto the department of revenue at the time of registration of a motorvehicle. Upon presentation of the annual statement, payment of a fifteendollar fee in addition to the registration fee and documents which may berequired by law, the department of revenue shall issue to the vehicle ownera personalized license plate which shall bear the emblem of the Friends ofKids with Cancer and shall bear the words "FRIENDS OF KIDS WITH CANCER" inplace of the words "SHOW-ME STATE". Such license plates shall be made withfully reflective material with a common color scheme and design, shall beclearly visible at night, and shall be aesthetically attractive, asprescribed by section 301.130. Notwithstanding the provisions of section301.144, no additional fee shall be charged for the personalization oflicense plates pursuant to this section.

3. A vehicle owner, who was previously issued a plate with theFriends of Kids with Cancer emblem authorized by this section but who doesnot provide an emblem-use authorization statement at a subsequent time ofregistration, shall be issued a new plate which does not bear the Friendsof Kids with Cancer emblem, as otherwise provided by law.

4. The director of revenue shall make necessary rules and regulationsfor the administration of this section, and shall design all necessaryforms required by this section. Any rule or portion of a rule, as thatterm is defined in section 536.010, RSMo, that is created under theauthority delegated in this section shall become effective only if itcomplies with and is subject to all of the provisions of chapter 536, RSMo,and, if applicable, section 536.028, RSMo. This section and chapter 536,RSMo, are nonseverable and if any of the powers vested with the generalassembly pursuant to chapter 536, RSMo, to review, to delay the effectivedate, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2004, shall be invalid and void.
