Lewis and Clark expedition anniversary special license plates,application, fee.

301.3133. 1. Any vehicle owner, after an annual contribution to theMissouri Travel Council, may receive special license plates commemoratingthe bicentennial anniversary of the Lewis and Clark expedition for anyvehicle the member owns, either solely or jointly, other than anapportioned motor vehicle or a commercial motor vehicle licensed in excessof eighteen thousand pounds gross weight. The Missouri Travel Council, inconjunction with the department of revenue, shall design the Lewis andClark bicentennial special license plate. The background of the plateshall depict a full-color image, covering the entire plate, and lightenedacross two-thirds of the area so as not to hinder the readability of thelicense plate registration number. Such license plates shall be made withfully reflective material, shall be clearly visible at night, and shall beaesthetically attractive, as prescribed by section 301.130.

2. Upon making a twenty-five dollar contribution to the MissouriTravel Council, the motor vehicle owner may apply for the special licenseplate commemorating the bicentennial anniversary of the Lewis and Clarkexpedition. If the contribution is made directly to the Missouri TravelCouncil, the Missouri Travel Council shall issue the individual making thecontribution a receipt, verifying the contribution, that may be used toapply for the Lewis and Clark special license plate. If the contributionis made directly to the director of revenue, the director shall note thecontribution and the owner may then apply for the Lewis and Clark plate.The applicant for such special license plate must pay a fifteen dollar feein addition to the regular registration fees and present any otherdocumentation required by law for each set of Lewis and Clark plates issuedpursuant to this section. Notwithstanding the provisions of section301.144, no additional fee shall be charged for the personalization oflicense plates issued pursuant to this section.

3. The director of revenue may promulgate rules and regulations forthe administration of this section. Any rule or portion of a rule, as thatterm is defined in section 536.010, RSMo, that is created under theauthority delegated in this section shall become effective only if itcomplies with and is subject to all of the provisions of chapter 536, RSMo,and, if applicable, section 536.028, RSMo. This section and chapter 536,RSMo, are nonseverable, and if any of the powers vested with the generalassembly pursuant to chapter 536, RSMo, to review, to delay the effectivedate, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2004, shall be invalid and void.

4. A vehicle owner who was previously issued a Lewis and Clarkspecial license plate pursuant to this section, but does not provide areceipt evidencing a contribution to the Missouri Travel Council or make acontribution directly to the department of revenue at a subsequent time ofregistration, shall be issued a new license plate which does notcommemorate the bicentennial anniversary of the Lewis and Clark expedition.The director of revenue shall make necessary rules and regulations for theenforcement of this section, and shall design all necessary forms requiredby this section.
