301.3141. 1. Any parent or sibling who has had a member of his orher immediate family die in the line of duty while serving in the U.S.armed forces, after making an annual payment described in subsection 2 ofthis section to the Veterans of Foreign Wars Department of Missouri andpaying all applicable registration fees, may receive special license platesfor any vehicle the person owns, either solely or jointly, other than anapportioned motor vehicle or a commercial motor vehicle licensed in excessof eighteen thousand pounds gross weight. The Veterans of Foreign WarsDepartment of Missouri, in conjunction with the director of the departmentof revenue, shall design the special license plate. Any immediate familymember of a fallen soldier may apply annually for the use of the emblem.

2. Upon making a twenty-five dollar contribution to the Veterans ofForeign Wars Department of Missouri, the motor vehicle owner may apply forthe special license plate described in this section. If the contributionis made directly to the Veterans of Foreign Wars Department of Missouri,the Veterans of Foreign Wars Department of Missouri shall issue theindividual making the contribution a receipt, verifying the contribution,that may be used to apply for the special license plate. If thecontribution is made directly to the director of revenue, the directorshall note the contribution, and the owner then may apply for the speciallicense plate. All contribution fees shall be remitted to the Veterans ofForeign Wars Department of Missouri.

3. Upon presentation of the receipt described in subsection 2 of thissection or payment of the twenty-five dollar contribution directly to thedepartment of revenue, payment of a fifteen dollar fee in addition to theregular registration fees, presentation of any documents that may berequired by law, and any proof that the applicant's family member died inthe line of duty while serving in the United States armed forces as thedirector may require, the director of revenue shall issue to the vehicleowner a special license plate that shall bear the emblem of a five-pointedstar and the words "SOME GAVE ALL" in place of the words "SHOW-ME STATE".Such license plates shall be made with fully reflective material with acommon color scheme and design of the standard license plate, shall beclearly visible at night, shall have a reflective white background in thearea of the plate configuration, and shall be aesthetically attractive, asprescribed by section 301.130. Notwithstanding the provisions of section301.144, no additional fee shall be charged for the personalization oflicense plates under this section.

4. A vehicle owner who previously was issued a special license plateauthorized by this section, but who does not provide a receipt as describedunder subsection 2 of this section at a subsequent time of registration,shall be issued a new plate that does not bear the emblem described in thissection, as otherwise provided by law. The director of revenue shall makenecessary rules and regulations for the enforcement of this section andshall design all necessary forms required by this section. Any rule orportion of a rule, as that term is defined in section 536.010, RSMo, thatis created under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2006, shall be invalidand void.

5. The provisions of section 301.3150 shall not apply to thespecialized license plate created under this section.
