Camp Quality special license plates, application, fee.
301.3144. 1. Any person may receive special license plates asprescribed by this section, for any motor vehicle such person owns, eithersolely or jointly, other than an apportioned motor vehicle or a commercialmotor vehicle licensed in excess of eighteen thousand pounds gross weight,after an annual contribution of an emblem-use authorization fee to CampQuality of Missouri. Any contribution given pursuant to this section shallbe designated for the sole use of providing scholarships to children withcancer who are residents of the state of Missouri for attendance at anysummer camp conducted by Camp Quality in the state of Missouri. CampQuality of Missouri hereby authorizes the use of its official emblem to beaffixed on single-year or multiyear personalized license plates as providedin this section. Any person may annually or biannually apply for the useof the emblem.
2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to Camp Quality of Missouri, that organizationshall issue to the vehicle owner, without further charge, an emblem-useauthorization statement, which shall be presented by the owner to thedepartment of revenue at the time of registration of a motor vehicle. Uponpresentation of the annual or biannual statement, payment of a fifteendollar fee, in addition to the registration fees, and presentation of otherdocuments which may be required by law, the department of revenue shallissue to the vehicle owner a personalized license plate which shall bearthe emblem of Camp Quality of Missouri and shall bear the words "CAMPQUALITY-FUN FOR KIDS WITH CANCER" in the place of the words "SHOW-MESTATE". Such license plates shall be made with fully reflective materialwith a common color scheme and design, shall be clearly visible at night,and shall be aesthetically attractive, as prescribed by section 301.130.Notwithstanding the provisions of section 301.144, no additional fee shallbe charged for the personalization of license plates pursuant to thissection.
3. A vehicle owner, who was previously issued a plate with the CampQuality of Missouri emblem authorized by this section but who does notprovide an emblem-use authorization statement at a subsequent time ofregistration, shall be issued a new plate which does not bear the CampQuality of Missouri emblem, as otherwise provided by law.
4. The director of the department of revenue shall make necessaryrules and regulations for the administration of this section, and shalldesign all necessary forms required by this section. Any rule or portionof a rule, as that term is defined in section 536.010, RSMo, that iscreated under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2004, shall be invalidand void.
