American Heart Association special license plates, application, fee.

301.3145. 1. Any supporter of the American Heart Association ofappropriate age as prescribed by law may receive special license plates asprescribed by this section, for any motor vehicle such person owns, eithersolely or jointly, other than an apportioned motor vehicle or a commercialmotor vehicle licensed in excess of eighteen thousand pounds gross weight,after an annual payment of an emblem-use authorization fee to the AmericanHeart Association of which the person is a supporter. The American HeartAssociation hereby authorizes the use of its official emblem red dress iconto be affixed on multiyear personalized license plates as provided in thissection. Any contribution to the American Heart Association derived fromthis section, except reasonable administrative costs, shall be used solelyfor the purposes of the American Heart Association. Any supporter of theAmerican Heart Association may annually apply for the use of the emblem andpay the twenty-five dollar emblem-use authorization fee at any localdistrict council in the state.

2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to the American Heart Association, the organizationshall issue to the vehicle owner, without further charge, an emblem-useauthorization statement, which shall be presented by the owner to thedepartment of revenue at the time of registration of a motor vehicle. Uponpresentation of the annual statement, payment of a fifteen dollar fee inaddition to the registration fee and documents which may be required bylaw, the department of revenue shall issue to the vehicle owner apersonalized license plate which shall bear the emblem of the red dressicon on the left side of the plate and the words "WINNING WOMEN" shallreplace the words "SHOW-ME STATE". Such license plates shall be made withfully reflective material with a common color scheme and design, shall beclearly visible at night, and shall be aesthetically attractive, asprescribed by section 301.130. Notwithstanding the provisions of section301.144, no additional fee shall be charged for the personalization oflicense plates pursuant to this section.

3. A vehicle owner, who was previously issued a plate with the reddress icon emblem authorized by this section but who does not provide anemblem-use authorization statement at a subsequent time of registration,shall be issued a new plate which does not bear the red dress icon emblem,as otherwise provided by law. The director of revenue shall make necessaryrules and regulations for the administration of this section. Any rule orportion of a rule, as that term is defined in section 536.010, RSMo, thatis created under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2004, shall be invalidand void.
