Missouri conservation heritage foundation, special licenseplate--application, procedure, design, fee.

301.469. 1. Any vehicle owner may receive license plates asprescribed in this section, for any motor vehicle such person owns, eithersolely or jointly, other than an apportioned motor vehicle or a commercialmotor vehicle licensed in excess of eighteen thousand pounds gross weight,after an annual payment of an emblem-use authorization fee to the Missouriconservation heritage foundation. The foundation hereby authorizes the useof its official emblems to be affixed on multiyear license plates asprovided in this section. Any vehicle owner may annually apply for the useof the emblems.

2. Upon annual application and payment of a twenty-five dollaremblem-use authorization fee to the Missouri conservation heritagefoundation, the foundation shall issue to the vehicle owner, withoutfurther charge, an emblem-use authorization statement, which shall bepresented to the director of the department of revenue at the time ofregistration of a motor vehicle.

3. Upon presentation of the annual statement, payment of a fifteendollar fee in addition to the regular registration fees and documents whichmay be required by law, the director of the department of revenue shallissue a license plate, which shall bear an emblem of the Missouriconservation heritage foundation in a form prescribed by the director, tothe vehicle owner. Such license plates shall be made with fully reflectivematerial with a common color scheme and design, shall be clearly visible atnight, and shall be aesthetically attractive, as prescribed by section301.130. Notwithstanding the provisions of section 301.144, no additionalfee shall be charged for the personalization of license plates pursuant tothis section.

4. A vehicle owner, who was previously issued a plate with a Missouriconservation heritage foundation emblem authorized by this section but whodoes not provide an emblem-use authorization statement at a subsequent timeof registration, shall be issued a new plate which does not bear thefoundation emblem, as otherwise provided by law.

5. The director of the department of revenue may promulgate rules andregulations for the administration of this section. Any rule or portion ofa rule, as that term is defined in section 536.010, RSMo, that ispromulgated under the authority delegated in this section shall becomeeffective only if it has been promulgated pursuant to the provisions ofchapter 536, RSMo. All rulemaking authority delegated prior to August 28,1999, is of no force and effect; however, nothing in this section shall beinterpreted to repeal or affect the validity of any rule filed or adoptedprior to August 28, 1999, if it fully complied with the provisions ofchapter 536, RSMo. This section and chapter 536, RSMo, are nonseverableand if any of the powers vested with the general assembly pursuant tochapter 536, RSMo, to review, to delay the effective date or to disapproveand annul a rule are subsequently held unconstitutional, then the grant ofrulemaking authority and any rule proposed or adopted after August 28,1999, shall be invalid and void.
