Boater identification card, notation for compliance with boatingsafety requirements--rulemaking authority.

302.184. Any resident of this state who possesses a boateridentification card issued by the Missouri state water patrol under section306.127, RSMo, may apply to the department of revenue to have a notationplaced on the person's driver's license or nondriver's license indicatingthat such person has complied with the provisions of section 306.127, RSMo.The department of revenue, by rule, may establish the cost and criteria forplacement of the notation. Any driver's license or nondriver's licensebearing such a notation may be used for identification in lieu of a boateridentification card issued under section 306.127, RSMo. Any rule orportion of a rule, as that term is defined in section 536.010, RSMo, thatis created under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2009, shall be invalidand void.
