Programs undertaken by displacing agency--relocation assistanceadvisory services--eligibility.

305.612. 1. Programs or projects undertaken by adisplacing agency shall be planned in a manner that:

(1) Recognizes, at an early stage in the planning of suchprograms or projects and before the commencement of any actionswhich will cause displacements, the problems associated with thedisplacement of individuals, families, businesses and farmoperations; and

(2) Provides for the resolution of such problems in orderto minimize adverse impacts in displaced persons and to expediteprogram or project advancement and completion.

2. The head of any displacing agency shall ensure that therelocation assistance advisory services described in subsection3 of this section are made available to all persons displaced bysuch agency. If such agency head determines that any personoccupying property immediately adjacent to the property wherethe displacing activity occurs has caused substantial economicinjury as a result thereof, the agency head may make availableto such person such advisory services.

3. Each relocation assistance advisory program required bysubsection 2 of this section shall include such measures,facilities or services as may be necessary or appropriate inorder to:

(1) Determine, and make timely recommendations on, theneeds and preferences, if any, of displaced persons forrelocation assistance;

(2) Provide current and continuing information on theavailability, sales prices and rental charges of comparablereplacement dwellings for displaced homeowners and tenants andsuitable locations for businesses and farm operations;

(3) Assure that a person shall not be required to move froma dwelling unless the person has had a reasonable opportunity torelocate to a comparable replacement dwelling.

4. The head of a displacing agency shall coordinate therelocation activities performed by such agency with otherfederal, state or local governmental actions in the communitywhich could affect the efficient and effective delivery ofrelocation assistance and related services.

5. In any case in which a displacing agency acquiresproperty for a program or project, any person who occupies suchproperty on a rental basis for a short term or a period subjectto termination when the property is needed for the program orproject shall be eligible for advisory services to the extentdetermined by the displacing agency.
