28-1012. Law enforcementofficer; powers; immunity; seizure; court powers.(1)Any law enforcement officer who has reason to believe that an animal has beenabandoned or is being cruelly neglected or cruelly mistreated may seek a warrantauthorizing entry upon private property to inspect, care for, or impound theanimal.(2) Any law enforcement officer who has reason to believethat an animal has been abandoned or is being cruelly neglected or cruellymistreated may issue a citation to the owner as prescribed in sections 29-422to 29-429.(3) Any animal, equipment, device, or other property or thingsinvolved in a violation of section 28-1009 or 28-1010 shall be subject toseizure and distribution or disposition shall be made under section 29-818 and in such manner as thecourt may direct.(4) Any animal involved in a violation of section 28-1009or 28-1010 shall be subject to seizure. Distribution or disposition shall be made undersection 29-818 and in such manner as the court may direct. Thecourt may consider adoption alternatives through humane societies or comparableinstitutions and the protection of such animal's welfare. For a humane societyor comparable institution to be considered as an adoption alternative underthis subsection, it must first be licensed by the Department of Agricultureas having passed the inspection requirements in the Commercial Dog and CatOperator Inspection Act and paid the fee for inspection under the act. Thecourt may prohibit an adopting or purchasing party from selling such animalfor a period not to exceed one year.(5) Any law enforcement officer acting under this sectionshall not be liable for damage to property if such damage is not the resultof the officer's negligence.
