38-2871. Prescriptioninformation; transfer; requirements.Originalprescription information for any controlled substances listed in ScheduleIII, IV, or V of section 28-405 and other prescription drugs or devices notlisted in section 28-405 may be transferred between pharmacies for the purposeof refill dispensing on a one-time basis, except that pharmacies electronicallyaccessing a real-time, on-line data base may transfer up to the maximum refillspermitted by law and as authorized by the prescribing practitioner on the prescription.Transfers are subject to the following:(1) The transfer is communicated directly between two pharmacistsor pharmacist interns except when the pharmacies can use a real-time, on-linedata base;(2) The transferring pharmacist or pharmacist intern indicatesvoid on the record of the prescription;(3) The transferring pharmacist or pharmacist intern indicateson the record of the prescription the name, the address, and, if a controlledsubstance, the Drug Enforcement Administration number of the pharmacy to whichthe information was transferred, the name of the pharmacist or pharmacistintern receiving the information, the date of transfer, and the name of thetransferring pharmacist or pharmacist intern;(4) The receiving pharmacist or pharmacist intern indicateson the record of the transferred prescription that the prescription is transferred;(5) The transferred prescription includes the following information:(a) The date of issuance of the original prescription;(b) The original number of refills authorized;(c) The date of original dispensing;(d) The number of valid refills remaining;(e) The date and location of last refill; and(f) The name, the address, and, if a controlled substance,the Drug Enforcement Administration number of the pharmacy from which thetransfer was made, the name of the pharmacist or pharmacist intern transferringthe information, the original prescription number, and the date of transfer;and(6) Both the original and transferred prescriptions mustbe maintained by the transferring and receiving pharmacy for a period of fiveyears from the date of transfer.
