85-1103.02. Out-of-state institution of higher education; courses or degree programs; application; hearing.(1) Out-of-state institutions of higher education shall make application for authorization to offer college credit courses or degree programs within the State of Nebraska on forms prescribed by the Coordinating Commission for Postsecondary Education. Following receipt of a complete application, the commission shall set a time and place for a public hearing and shall cause notice of the hearing to be published in one or more newspapers of general circulation in the affected county or counties not less than thirty days or more than sixty days prior to the date set for the hearing. The hearing shall be held as provided in the Administrative Procedure Act.(2) Following the public hearing, the commission shall either approve or disapprove the application for authorization to offer college credit courses or degree programs in the state. If approved, the commission shall specify in its approval the level and range of courses or degree programs which the applying institution is authorized to offer in the state.
