§1‑438.  When bail to pay costs.

When a notice issues against aperson, as the bail of another, and the bail, at or before the term of thecourt at which he is bound to appear, or ought to plead, is not discharged fromhis liability by the death or surrender of his principal or otherwise, he isliable for all costs which accrue on said notice, notwithstanding he may beafterwards discharged, by the death or surrender of the principal, orotherwise.
