§ 113‑77.8.  Natural Heritage Trust Fund Boardof Trustees.

(a)        Expenditures from the Fund shall be authorized by a 12‑memberBoard of Trustees. Four members shall be appointed by the Governor, four by theGeneral Assembly upon the recommendation of the President Pro Tempore of theSenate in accordance with G.S. 120‑121, and four by the General Assemblyupon the recommendation of the Speaker of the House of Representatives inaccordance with G.S. 120‑121. Persons appointed shall be knowledgeable inthe acquisition and management of natural areas. Each appointing officer shalldesignate one of his initial appointments to serve a two‑year term, oneto serve a four‑year term, and one to serve a six‑year term.Thereafter, all appointments shall be for six years, subject to reappointment.Appointments shall expire January 1 of even‑numbered years. The Governorshall appoint one Trustee to serve as Chairman of the Board. The Secretaryshall provide the Trustees with staff support and meeting facilities usingexpenditures from the Fund. The office of Trustee is declared to be an officethat may be held concurrently with any other executive or appointive office,under the authority of Article VI, Section 9, of the North CarolinaConstitution.

(b)        The Trustees shall meet at least once each year and may holdspecial meetings at the call of the Chairman or a majority of the members.

(c)        The Trustees shall receive the per diem allowed for othermembers of boards and commissions of the State as fixed in the Biennial AppropriationsAct, and, in addition, the Trustees shall receive subsistence and travelexpenses as fixed by statute for such purposes. Travel and subsistence expensesshall be allowed while going to or from any place of meeting or when onofficial business. Per diem payments shall include necessary time spent intraveling to and from their places of residence to any meeting place or whiletraveling on official business. Per diem, subsistence, and travel expenses ofthe Trustees shall be paid from the Fund. (1987, c. 871, s. 1; 1989, c. 86, s. 1; 1993 (Reg.
