§ 115C‑111.1.  Out‑of‑statestudents; eligibility for State funds.

Notwithstanding any policy orrule adopted by the State Board of Education, if a local school administrativeunit provides services to a student under a current IEP from another statewhile a determination is being made regarding the student's eligibility forservices as a child with disabilities in North Carolina, the local schooladministrative unit is entitled to receive State funding to serve the studentwhile the determination is being made. If the student is later determined notto qualify for services in North Carolina, the local school administrative unitis not required to repay State funds received while the determination is beingmade.
