§ 116‑143.7.  Tuitionsurcharge.

(a)        (Effectivebeginning with the 2009‑2010 academic year) The Board of Governors ofThe University of North Carolina shall impose a twenty‑five percent (25%)tuition surcharge on students who take more than 140 degree credit hours tocomplete a baccalaureate degree in a four‑year program or more than onehundred ten percent (110%) of the credit hours necessary to complete abaccalaureate degree in any program officially designated by the Board ofGovernors as a five‑year program. Courses and credit hours taken includethose taken at a constituent institution or accepted for transfer. Incalculating the number of degree credit hours taken:

(1)        Included are coursesthat a student:

a.         Fails.

b.         Does not completeunless the course was officially dropped by the student pursuant to theacademic policy of the appropriate constituent institution.

(2)        Excluded are credithours earned through:

a.         The College Board'sAdvanced Placement Program, CLEP examinations, or similar programs.

b.         Institutionaladvanced placement, course validation, or any similar procedure for awardingcourse credit.

c.         Summer term orextension programs.

(a)        (Effectivebeginning with the 2010‑2011 academic year) The Board of Governors ofThe University of North Carolina shall impose a fifty percent (50%) tuitionsurcharge on students who take more than 140 degree credit hours to complete abaccalaureate degree in a four‑year program or more than one hundred tenpercent (110%) of the credit hours necessary to complete a baccalaureate degreein any program officially designated by the Board of Governors as a five‑yearprogram. Courses and credit hours taken include those taken at that constituentinstitution or accepted for transfer. In calculating the number of degreecredit hours taken:

(1)        Included are coursesthat a student:

a.         Fails.

b.         Does not completeunless the course was officially dropped by the student pursuant to theacademic policy of the appropriate constituent institution.

(2)        Excluded are credithours earned through:

a.         The College Board'sAdvanced Placement Program, CLEP examinations, or similar programs.

b.         Institutionaladvanced placement, course validation, or any similar procedure for awardingcourse credit.

c.         Summer term orextension programs.

(b)        No surcharge shallbe imposed on any student who exceeds the degree credit hour limits within theequivalent of four academic years of regular term enrollment or within fiveacademic years of regular term enrollment in a degree program officiallydesignated by the Board of Governors as a five‑year program.

(c)        Upon application bya student, the tuition surcharge shall be waived if the student demonstratesthat any of the following have substantially disrupted or interrupted thestudent's pursuit of a degree: (i) a military service obligation, (ii) seriousmedical debilitation, (iii) a short‑term or long‑term disability,or (iv) other extraordinary hardship. The Board of Governors shall establishthe appropriate procedures to implement the waiver provided by this subsection. (2009‑451,s. 9.10(a), (b).)
