Part 3. Inactive Hazardous Sites.

§ 130A‑310. Definitions.

Unless a different meaning isrequired by the context, the following definitions shall apply throughout thisPart:

(1)        "CERCLA/SARA"means the Comprehensive Environmental Response, Compensation, and Liability Actof 1980, Pub. L. 96‑510, 94 Stat. 2767, 42 U.S.C. 9601 et seq., asamended, and the Superfund Amendments and Reauthorization Act of 1986, Pub. L.99‑499, 100 Stat. 1613, as amended.

(2)        "Hazardoussubstance" means hazardous substance as defined in CERCLA/SARA.

(3)        "Inactivehazardous substance or waste disposal site" or "site" means anyfacility, as defined in CERCLA/SARA. These sites do not include hazardous wastefacilities permitted or in interim status under this Article.

(4)        "Operator"means the person responsible for the overall operation of an inactive hazardoussubstance or waste disposal site.

(5)        "Owner"means any person who owns an inactive hazardous substance or waste disposalsite, or any part thereof.

(6)        "Release"means release as defined in the CERCLA/SARA.

(7)        "Remedy"or "Remedial Action" means remedy or remedial action as defined inCERCLA/SARA.

(8)        "Remove"or "Removal" means remove or removal as defined in CERCLA/SARA.

(9)        "Responsibleparty" means any person who is liable pursuant to G.S. 130A‑310.7. (1987,c. 574, s. 2; 1989, c. 286, s. 2; 1999‑83, s. 1.)
