Part 2. Administrative Structure.

§ 135‑44.  Board ofTrustees established.

(a)        There isestablished the Board of Trustees of the State Health Plan for Teachers andState Employees.

(b)        The Board ofTrustees of the State Health Plan for Teachers and State Employees shallconsist of nine members.

(c)        Three members shallbe appointed by the Governor. Terms shall be for two years. Vacancies shall befilled by the Governor. Of the members appointed by the Governor, one shall beeither:

(1)        An employee of aState department, agency, or institution;

(2)        A teacher employedby a North Carolina public school system;

(3)        A retired employeeof a State department, agency, or institution; or

(4)        A retired teacherfrom a North Carolina public school system.

(d)        Three members shallbe appointed by the General Assembly upon the recommendation of the Speaker ofthe House of Representatives in accordance with G.S. 120‑121. Terms shallbe for two years. Vacancies shall be filled in accordance with G.S. 120‑122.

(e)        Three members shallbe appointed by the General Assembly upon the recommendation of the PresidentPro Tempore of the Senate in accordance with G.S. 120‑121. Terms shall befor two years. Vacancies shall be filled in accordance with G.S. 120‑122.

(f)         Each appointing authoritymay remove any member appointed by that appointing authority.

(g)        The members of theBoard of Trustees shall receive one hundred dollars ($100.00) per day, exceptemployees eligible to enroll in the Plan, whenever the full Board of Trusteesholds a public session, and travel allowances under G.S. 138‑6 whentraveling to and from meetings of the Board of Trustees or hearings under G.S.135‑44.7, but shall not receive any subsistence allowance or per diemunder G.S. 138‑5, except when holding a meeting or hearing where thissection does not provide for payment of one hundred dollars ($100.00) per day.

(h)        No member of theBoard of Trustees may serve more than three consecutive two‑year terms.

(i)         Meetings of theBoard of Trustees may be called by the Executive Administrator, the Chair, orby any three members.  (1981 (Reg.
