Article 67.

First Flight Centennial Commission.

§ 143‑640.  Commission established; purpose;members; terms of office; quorum; compensation; termination.

(a)        Establishment. – There is established the First FlightCentennial Commission. The Commission shall be located within the Department ofCultural Resources for organizational, budgetary, and administrative purposes.

(b)        Purpose. – The purpose of the Commission is to develop andplan activities to commemorate the centennial of the first successful manned,controlled, heavier‑than‑air, powered flight (in this Articlereferred to as "the First Flight") and other historical eventsrelated to the development of powered flight.

(c)        Membership. – The Commission shall consist of 29 members, asfollows:

(1)        Four persons appointed by the Governor.

(2)        Five persons appointed by the President Pro Tempore of theSenate.

(3)        Five persons appointed by the Speaker of the House ofRepresentatives.

(4)        The following persons or their designees, ex officio:

a.         The Governor.

b.         The President Pro Tempore of the Senate.

c.         The Speaker of the House of Representatives.

d.         The United States Senators from this State.

e.         The member of the United States House of Representatives forthe Third Congressional District.

f.          The Governor of the State of Ohio.

g.         The Secretary of the Department of Cultural Resources.

h.         The Superintendent of the Cape Hatteras National Seashore ofthe United States National Park Service.

i.          The chair of the Centennial of Flight CommemorationCommission.

j.          The President of the First Flight Society.

k.         The chair of the Dare County Board of Commissioners.

l.          The Mayor of the Town of Kill Devil Hills.

m.        The chair of the Dare County Tourism Board.

n.         The Mayor of the Town of Kitty Hawk.

The members appointed to the First Flight Centennial Commission shallbe chosen from among individuals who have the ability and commitment to promoteand fulfill the purposes of the Commission, including individuals who havedemonstrated expertise in the fields of aeronautics, aerospace science, orhistory, who have contributed to the development of the fields of aeronauticsor aerospace science, or who have demonstrated a commitment to serving thepublic.

(d)        Terms. – Members shall serve for two‑year terms, withno prohibition against being reappointed, except initial appointments shall befor terms as follows:

(1)        The Governor shall initially appoint two members for a termof two years and two members for a term of three years.

(2)        The President Pro Tempore of the Senate shall initiallyappoint two members for a term of two years and two members for a term of threeyears.

(3)        The Speaker of the House of Representatives shall initiallyappoint two members for a term of two years and two members for a term of threeyears.

Initialterms shall commence on July 1, 1994.

(e)        Cochairs. – The Governor shall select the cochairsbiennially from among the membership of the Commission. The initial term shallcommence on July 1, 2001.

(f)         Vacancies. – A vacancy in the Commission or as chair of theCommission resulting from the resignation of a member or otherwise shall befilled in the same manner in which the original appointment was made and theterm shall be for the balance of the unexpired term.

(g)        Compensation. – The Commission members shall receive nosalary as a result of serving on the Commission but shall receive per diem,subsistence, and travel expenses in accordance with the provisions of G.S. 120‑3.1,138‑5, and 138‑6, as applicable. When approved by the Commission,members may be reimbursed for subsistence and travel expenses in excess of thestatutory amount.

(h)        Removal. – Members may be removed in accordance with G.S.143B‑13 as if that section applied to this Article.

(i)         Meetings. – The chair shall convene the Commission.Meetings shall be held as often as necessary, but not less than four times ayear.

(j)         Quorum. – A majority of the members of the Commission shallconstitute a quorum for the transaction of business. The affirmative vote of amajority of the members present at meetings of the Commission shall benecessary for action to be taken by the Commission.

(k)        Termination of Commission. – The Commission shall terminateJune 30, 2004, which is six months after the 100th anniversary of the FirstFlight. (1993 (Reg. Sess., 1994),c. 777, s. 7(a); 1999‑431, s. 3.2(a); 2001‑486, ss. 2.12(a),2.12(b); 2002‑159, s. 20.)
