§ 143B‑437.91.  NorthCarolina Wine and Grape Growers Council – Composition; terms; reimbursement.

(a)        The North CarolinaWine and Grape Growers Council shall consist of 11 members appointed by theSecretary of Commerce in the following manner: seven commercial grape growers;three winery operators; and one retailer of North Carolina grape products. Forpurposes of this Article, a commercial grape grower is one who has at leastthree acres of grapes or sells ten thousand dollars ($10,000) worth of grapes annually.The Secretary shall appoint members for staggered four‑year terms.Members shall serve until their successors are appointed and qualified. Anymember of the Council may be reappointed for additional terms. Any appointmentto fill a vacancy on the Council shall be for the balance of the unexpiredterm. Any member of the Council may be removed by the Secretary formisfeasance, malfeasance, or nonfeasance.

(b)        Members of theCouncil shall receive per diem and necessary travel and subsistence expenses inaccordance with G.S. 138‑5 from funds appropriated for the operation ofthe Council.

(c)        All clerical andother services required by the Council may be provided by the Department ofCommerce.

(d)        The Secretary ofCommerce shall appoint a chair who shall serve at the pleasure of theSecretary.

(e)        The Council mayselect a secretary who need not be a member of the Council.

(f)         The Council shallmeet when necessary as determined by the chair or upon written request of amajority of the members.
