§147‑86.33.  Health and Wellness Trust Fund; powers and duties.

(a)        The Commissionshall do the following:

(1)        Allocate moneys fromthe Fund as grants. A grant may be awarded only for a program or initiativethat satisfies the criteria and furthers the purposes of this Article, but theprovisions of this Article shall be liberally construed. The Commission shallstrive to avoid imposing any unnecessary barriers in the grant applicationprocess.

(2)        Develop criteria forawarding grants under this Article. The criteria shall include types ofprograms and initiatives to be funded, including programs which address theshort‑ and long‑term health and wellness of the citizens of NorthCarolina.

(3)        Develop criteria bywhich to measure the outcomes of funded programs to evaluate the extent towhich those programs achieved the goals for which funds were awarded.

(4)        Develop a mechanismwith which to evaluate individual applications.

(5)        Ensure that goodfaith efforts are made to achieve federal mandates targeting the reduction ofyouth access to tobacco products.

(6)        Administer theprovisions of this Article.

(7)        Adopt rules toimplement this Article.

(b)        The Commission isauthorized to hire staff or contract for other expertise for the administrationof the Fund.

(c)        Gifts and Grants. –The Commission is authorized to accept gifts or grants from other sources. (2000‑147,s. 2.)
