§ 159I‑11.  Priorityfactors.

(a)        The Commission forPublic Health shall adopt, pursuant to Chapter 150B of the General Statutes,rules for the assignment of a priority to each application for a loan underthis Chapter.

(b)        An application fora loan under this Chapter shall be assigned a priority by the Division. Factorsto be taken into consideration in assigning such priorities shall include, butare not limited to, projects identified by the Division as addressing emergencysolid waste management situations, current implementation by the unit of localgovernment of a recycling program or a waste stream reduction program;financial need; multi‑county solid waste management projects; groundwaterprotection needs; local effort; public health needs; and the proposed purposeof the applicant's loan is to implement a method of disposal that is analternative to landfilling.

(c)        A written statementof each priority assigned shall be prepared by the Division and shall beattached to the application. The priority assigned shall be conclusive.

(d)        Any applicationthat does not qualify for a loan for the period in which the application waseligible for consideration by reason of the priority assigned shall beconsidered for a loan during the next period upon written request of theapplicant. If the second application should fail to qualify for a loan duringthe period for consideration by reason of the priority assigned, theapplication shall receive no further consideration. An applicant may file a newor amended application at any time. (1989, c. 756, s. 1; 2007‑182, s. 2.)
