§15A‑739.  Persons under criminal prosecution in this State at time ofrequisition.

If a criminal prosecution hasbeen instituted against such person under the laws of this State and is stillpending, the Governor, in his discretion, either may surrender him on demand ofthe executive authority of another state or hold him until he has been triedand discharged or convicted and punished in this State. (1937,c. 273, s. 19; 1973, c. 1286, s. 16.)
