§ 160A‑345. Authority to condemn cemeteries.

A city shall have authority to acquire title in fee simple by purchaseor exercise of the power of eminent domain to any cemetery, graveyard, orburial place within the city and to operate and maintain the property soacquired as a city cemetery. This section shall not apply to a cemeterylicensed by the North Carolina State Burial Association Commissioner, nor toproperty owned or controlled by any church or religious organization, unlessthe owner of the property consents to the acquisition.
