§ 160A‑634. Territorial jurisdiction and service area of the Authority.

(a)        The territorial jurisdiction and service area of theAuthority shall be as determined by the Board of Trustees consistent with itspurpose, but shall initially consist of those areas included within theMetropolitan Planning Organization boundaries. With the consent by resolutionof the affected board of county commissioners, the jurisdiction and area may beexpanded to include contiguous areas, but the total jurisdiction and servicearea shall not exceed part or all of 12 counties. The jurisdiction and areainclude the entire area of the county if the Board of Trustees has beenexpanded to include the chair or other member of the board of commissioners ofthat county pursuant to G.S. 160A‑635(a)(4).

(b)        Except as provided by this Article, the jurisdiction of theAuthority may include all local public passenger transportation operatingwithin the territorial jurisdiction of the Authority, but the Authority may nottake over the operation of any existing public transportation without theconsent of the owner.

(c)        The Authority shall not have jurisdiction over publictransportation subject to the jurisdiction of and regulated by the UnitedStates Department of Transportation, nor shall it have jurisdiction overintrastate public transportation classified as common carriers of passengers bythe North Carolina Utilities Commission.
