§ 163‑202. Election after reapportionment of members of House of Representatives.

Whenever, by a new apportionment of members of the United States Houseof Representatives, the number of Representatives from North Carolina shall bechanged, and neither the Congress nor the General Assembly shall provide forelecting them, the following procedures shall apply:

(1)        If the number of Representatives is increased, theRepresentative from each of the existing congressional districts shall beelected by the qualified voters of his district, and the additionalRepresentatives apportioned to North Carolina shall be elected on a singleballot by the qualified voters of the whole State.

(2)        If the number of Representatives is decreased, existingcongressional district lines shall be ignored, and all Representativesapportioned to North Carolina shall be elected on a single ballot by thequalified voters of the whole State.
