§ 163‑278.65. Distribution from the Fund.

(a)        Timing of FundDistribution. – The Board shall distribute to a certified candidate revenuefrom the Fund in an amount determined under subdivision (b)(4) of this sectionwithin five business days after the certified candidate's name is approved toappear on the ballot in a contested general election, but no earlier than fivebusiness days after the primary.

(b)        Amount of FundDistribution. – By August 1, 2003, and no less frequently than every two yearsthereafter, the Board shall determine the amount of funds, rounded to thenearest one hundred dollars ($100.00), to be distributed to certifiedcandidates as follows:

(1)        Uncontestedprimaries. – No funds shall be distributed.

(2)        Contested primaries.– No funds shall be distributed except as provided in G.S. 163‑278.67.

(3)        Uncontested generalelections. – No funds shall be distributed.

(4)        Contested generalelections. – Funds shall be distributed to a certified candidate for a positionon the Court of Appeals in an amount equal to 125 times the candidate's filingfee as set forth in G.S. 163‑107. Funds shall be distributed to acertified candidate for a position on the Supreme Court in an amount equal to175 times the candidate's filing fee as set forth in G.S. 163‑107.

(c)        Method of FundDistribution. – The Board, in consultation with the State Treasurer and theState Controller, shall develop a rapid, reliable method of conveying funds tocertified candidates. In all cases, the Board shall distribute funds to certifiedcandidates in a manner that is expeditious, ensures accountability, andsafeguards the integrity of the Fund. If the money in the Fund is insufficientto fully fund all certified candidates, then the available money shall bedistributed proportionally, according to each candidate's eligible funding, andthe candidate may raise additional money in the same manner as a noncertifiedcandidate for the same office up to the unfunded amount of the candidate'seligible funding.
