§ 166A‑6.02.  StateEmergency Response Account.

(a)        AccountEstablished. – There is established a State Emergency Response Account as areserve in the General Fund. Any funds appropriated to the Account shall remainavailable for expenditure as provided by this section, unless directedotherwise by the General Assembly.

(b)        Purpose of Funds. –The Governor may spend funds from the Account for the following purposes:

(1)        To cover the start‑upcosts of State Emergency Response Team operations for an emergency that posesan imminent threat of a Type I, Type II, or Type III disaster as defined byG.S. 166A‑6.

(2)        To cover the cost offirst responders to a Type I, Type II, or Type III disaster and any relatedsupplies and equipment needed by first responders that are not provided forunder subdivision (1) of this subsection.

All other types of disasterassistance authorized by G.S. 166A‑6 shall continue to be financed by thefunds made available under G.S. 166A‑6.01.

(c)        ReportingRequirement. – The Governor shall report to the Joint Legislative Commission onGovernmental Operations and to the Chairs of the Appropriations Committees ofthe Senate and House of Representatives on any expenditures from the StateEmergency Response Account no later than 30 days after making the expenditure.The report shall include a description of the emergency and type of actiontaken.
