§ 20‑215.2.  Power toregulate; rules and regulations establishing minimum standards.

Notwithstanding any otherprovisions of this Chapter the North Carolina Division of Motor Vehicles,hereinafter referred to as  "Division," is hereby vested with thepower and duty to make and enforce reasonable rules and regulations applicableto motor carriers of migratory farm workers to and from their places ofemployment. The rules promulgated shall establish minimum standards:

(1)        For the constructionand equipment of such vehicles, including coupling devices, lighting equipment,exhaust systems, rear vision mirrors, brakes, steering mechanisms, tires,windshield wipers and warning devices.

(2)        For the operation ofsuch vehicles, including driving rules, distribution of passengers and load,maximum hours of service for drivers, minimum requirements of age and skill ofdrivers, physical conditions of drivers and permits, licenses or othercredentials required of drivers.

(3)        For the safety andcomfort of passengers in such vehicles, including emergency kits, fireextinguishers, first‑aid equipment, sidewalls, seating accommodations,tail gates or doors, rest and meal stops, maximum number of passengers, andsafe means of ingress and egress.
