§ 20‑279.32. Exceptions.

This Article does not apply toa motor vehicle registered under G.S. 20‑382 by a for‑hire motorcarrier. This Article does not apply to any motor vehicle owned by the State ofNorth Carolina, nor does it apply to the operator of a vehicle owned by theState of North Carolina who becomes involved in an accident while operating thestate‑owned vehicle if the Commissioner determines that the vehicle atthe time of the accident was probably being operated in the course of theoperator's employment as an employee or officer of the State. This Article doesnot apply to any motor vehicle owned by a county or municipality of the Stateof North Carolina, nor does it apply to the operator of a vehicle owned by acounty or municipality of the State of North Carolina who becomes involved inan accident while operating such vehicle in the course of the operator'semployment as an employee or officer of the county or municipality. ThisArticle does not apply to the operator of a vehicle owned by a politicalsubdivision, other than a county or municipality, of the State of NorthCarolina who becomes involved in an accident while operating such vehicle ifthe Commissioner determines that the vehicle at the time of the accident wasprobably being operated in the course of the operator's employment as anemployee or officer of the subdivision providing that the Commissioner findsthat the political subdivision has waived any immunity it has with respect tosuch accidents and has in force an insurance policy or other method ofsatisfying claims which may arise out of the accident. This Article does notapply to any motor vehicle owned by the federal government, nor does it applyto the operator of a motor vehicle owned by the federal government who becomesinvolved in an accident while operating the government‑owned vehicle ifthe Commissioner determines that the vehicle at the time of the accident wasprobably being operated in the course of the operator's employment as anemployee or officer of the federal government.
