§28A‑19‑11.  Pleading statute of limitations.

When claims are not barredpursuant to G.S. 28A‑19‑3, it shall be within the discretion of thepersonal representative or collector acting in good faith to determine whetheror not any applicable statute of limitations shall be pleaded to bar a claimwhich he believes to be just. His admission of such claim or his decision notto plead the statute in an action brought on the claim shall, in the absence ofany showing of collusion or bad faith, be binding on all persons interested inthe estate. (1973, c. 1329, s. 3.)
