§ 28A‑28‑3. Clerk's order.

If it appears to the clerkthat the petition and supporting evidence, if any, comply with the requirementsof G.S. 28A‑28‑2 and on the basis thereof the spouse is entitled tosummary administration, the clerk shall enter an order to that effect and nofurther administration of the estate is necessary. Nothing in this sectionshall preclude a petition under the provisions of G.S. 28A‑28‑7(a)or the appointment of a personal representative or a collector under theprovisions of Article 6 or Article 11 of this Chapter.
