§ 48‑3‑206. Affidavit of parentage.

(a)        To assist the courtin determining that a direct placement was valid and all necessary consentshave been obtained, the parent or guardian who placed the minor shall executean affidavit setting out names, last known addresses, and marital status of theminor's parents or possible parents. If the placing parent or guardian isunavailable to execute the affidavit, the affidavit may be prepared by aknowledgeable individual who shall sign the affidavit and indicate the sourceof the individual's knowledge.

(b)        In an agencyplacement, the agency shall obtain from at least one individual whorelinquishes a minor to the agency an affidavit setting out the informationrequired in subsection (a) of this section. This affidavit is not necessarywhen the agency acquires legal and physical custody of a minor for purposes ofadoptive placement by a court order terminating the parental rights of a parentor guardian.
