§ 58‑51‑16. Intoxicants and narcotics.

(a)        Except for thepayment of benefits for the necessary care and treatment of chemical dependencyas provided by law, an accident and health insurer shall not be liable for anyloss sustained or contracted in consequence of the insured's being intoxicatedor under the influence of any narcotic unless administered on the advice of aphysician.

(b)        The provision insubsection (a) of this section may not be used with respect to a medicalexpense policy.

(c)        For purposes ofthis section, "medical expense policy" means an accident and healthinsurance policy that provides hospital, medical, and surgical expensecoverage. (2001‑334,s. 4.2.)
