§58‑51‑75.  Blanket accident and health insurance defined.

(a)        Any policy orcontract of insurance against death or injury resulting from accident or fromaccidental means which insures a group of persons conforming to therequirements of one of the following subdivisions (1) to (7), inclusive, shallbe deemed a blanket accident policy.  Any policy or contract which insures agroup of persons conforming to the requirements of one of the followingsubdivisions (3), (5), (6) or (7) against total or partial disability,excluding such disability from accident or from accidental means, shall bedeemed a blanket health insurance policy.  Any policy or contract of insurancewhich combines the coverage of blanket accident insurance and of blanket healthinsurance on such a group of persons shall be deemed a blanket accident andhealth insurance policy:

(1)        Under a policy orcontract issued to any railroad, steamship, motorbus or airplane carrier ofpassengers, which shall be deemed the policyholder, a group defined as allpersons who may become such passengers may be insured against death or bodilyinjury either while, or as a result of, being such passengers.

(2)        Under a policy orcontract issued to an employer, or the trustee of a fund established by theemployer, who shall be deemed the policyholder, covering any group of employeesdefined by reference to exceptional hazards incident to such employment,insuring such employee against death or bodily injury resulting while, or from,being exposed to such exceptional hazard.

(3)        Under a policy orcontract issued to a college, school or other institution of learning or to thehead or principal thereof, who or which shall be deemed the policyholder.

(4)        Under a policy orcontract issued in the name of any volunteer fire department, which shall bedeemed the policyholder, covering all of the members of such department.

(5)        Under a policy orcontract issued to and in the name of an incorporated or unincorporatedassociation of persons having a common interest or calling, which associationshall be deemed the policyholder, having not less than 25 members, and formedfor purposes other than obtaining insurance, covering all of the members ofsuch association.

(6)        Under a policy orcontract issued to the head of a family, who shall be deemed the policyholder,whereunder the benefits thereof shall provide for the payment by the insurer ofamounts for expenses incurred by the policyholder on account of hospitalizationor medical or surgical aid for himself, his spouse, his child or children, orother persons chiefly dependent on him for support and maintenance.

(7)        Under a policy orcontract issued in the name of any municipal or county recreation commission ordepartment which shall be deemed the policyholder.

(b)        All benefits underany blanket accident, blanket health or blanket accident and health insurancepolicy shall be payable to the person insured, or to his designated beneficiaryor beneficiaries, or to his estate, except that if the person insured be aminor, such benefits may be made payable to his parent, guardian, or otherperson actually supporting him, or to a person or persons chiefly dependentupon him for support and maintenance.

(c)        Nothing containedin this section shall be deemed to affect the legal liability of policyholdersfor the death of or injury to, any such member of such group. (1945,c. 385; 1947, c. 721; 1953, c. 1095, s. 5; 1961, c. 603.)
