§58‑65‑120. Medical, dental and hospital service associations andagent to transact business through licensed agents only.
No medical and/or dental orhospital service association; nor any agent of any association shall on behalfof such association or agent, knowingly permit any person not licensed as anagent as provided by law, to solicit, negotiate for, collect or transmit apremium for a new contract of medical and/or dental or hospital servicecertificate or to act in any way in the negotiation for any contract or policy;provided, no license shall be required of the following:
(1) Persons designatedby the association or subscriber to collect or deduct or transmit premiums orother charges for medical and/or dental care or hospital contracts, or to performsuch acts as may be required for providing coverage for additional persons whoare eligible under a master contract.
(2) An agency officeemployee acting in the confines of the agent's office, under the direction andsupervision of the duly licensed agent and within the scope of such agent'slicense, in the acceptance of request for insurance and payment of premiums,and the performance of clerical, stenographic, and similar office duties.
