§58‑79‑45.  Fire incident reports.

(a)        Whenever a firedepartment responds to a fire, the chief of that department shall complete orcause to be completed a fire incident report, which report shall be on a formprescribed by the Department of Insurance.  When such report is made withoutfraud, bad faith, or actual malice, the person making the report is not subjectto liability for libel or slander.

(b)        The fire departmentshall forward a copy of the completed form to the fire marshal of the county inwhich the fire occurred.  If there is no fire marshal in that county, the firedepartment shall forward a copy of the report to the county commissioners.  Thefire department shall retain the original of the report.  The fire departmentand the fire marshal or county commissioners to whom reports are sent shallretain the reports for a period of five years.

(c)        At the request ofany person, the county fire marshal or county commissioners shall provide suchperson, for a reasonable copying charge, a certified copy of the report. (1989(Reg. Sess., 1990), c. 1054, s. 7.)
